Petitioner has filed this writ petition seeking following reliefs: "(i) Issue a writ of Mandamus directing the Respondents to forthwith consider and appoint/promote the Petitioner on the vacant Scheduled Tribe-reserved post of Assistant Grade-III (LDC) in accordance with the Rules; (ii) Direct the Respondents to decide the Petitioner's representation dated 12.09.2025 within a time-bound period, preferably within 30 days; (iii) Grant all consequential benefits including seniority, pay fixation and arrears, from the date the post became available or from such date as this Hon'ble Court deems fit; (iv) Declare that the continued vacancy of ST- reserved LDC post since 2013 and non-consideration of the eligible Petitioner is illegal and violative of Articles 14, 16(1), 16(4) and 21 of the Constitution of India; (v) Any other order(s) deemed fit in the interests of justice." 2. Learned counsel for petitioner submits that petitioner was engaged on daily wage basis on the post of Peon in the year 2006. Petitioner continuously worked as daily wage employee and thereafter he was regularized in service in the year 2020. Petitioner became eligible for promotion to the post of Assistant Grade-III . Posts are also lying vacant in the department. However, when petitioner was not 3 / considered for promotion, he submitted representation before respondents on 12.09.2025 but till date said representation is also not considered and decided and therefore a direction be issued to concerned authority to take decision on the claim of petitioner by deciding the representation within specified time frame. 3. Learned counsel for the State submits that in view of limited prayer made by learned counsel for the petitioner she is having no objection. 4. On due consideration of submissions of learned counsel for the respective parties, nature of grievance raised, representation submitted by petitioner is pending consideration as submitted by petitioner, this writ petition is disposed of directing respondents to take decision on the pending representation of the petitioner dated 12.09.2025, expeditiously, preferably within a period of three months from the date of receipt of copy of this order. 5. Petitioner will also be at liberty to submit fresh representation if he so desires and if such representation is submitted, concerned authority shall consider and take decision on the representation to be submitted by petitioner along with pending representation.
