Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name of petitioner FIR No. Date Section(s) Police Station District Shinda Ram @ Shinda 196 14.10.2025 333, 190, 191(2), 329(2) of BNS, 2023. City Budhlada Mansa 2. Status report by way of affidavit of Sikander Singh, PPS, Dy.S.P., Sub Division Budhlada, District Mansa, has been filed in Court today. Same is taken on record and a copy has been supplied to learned counsel for the petitioner. 3. Learned counsel for the petitioner submits that petitioner Shinda Ram is not involved in any other case. On 13.05.2026, following order was passed:- “Learned counsel for the petitioner(s) contends that but LUCKY 2026.07.29 10:22 I attest to the accuracy and authenticity of this order/judgement High Court chandigarh CRM-M-27057-2026 -2- for the offence of trespass, all other offences are bailable. He submits that the petitioners have been attributed the role of having entered the house and engaging in vandalism, thus causing damage to the property of the complainant. It is contended that so far as petitioner-M Minor is concerned, he is of 16 years of age and would thus even otherwise be protected under the provisions of the Juvenile Justice (Care and Protection of Children) Act, 2015. It is further contended that so far as, petitioner Shinda Ram @ Shinda is concerned, he is not involved in any other case. He submits that the petitioner(s) are ready and willing to join the investigation as and when called for and to extend all cooperation to the Investigating Agency. Notice of motion. Mr. Mohit Kapoor, Sr. DAG Punjab accepts notice on behalf of respondent-State and prays for some time to complete instructions and file reply, if so advised. Reply, if any, be filed on or before the adjourned date with copy in advance to the learned counsel opposite. Adjourned to 27.07.2026. In the meanwhile, the petitioners are directed to join investigation as and when so required by the Investigating Agency. In the event of the petitioner(s) joining investigation, they shall be admitted to interim bail by the arresting officer/investigating officer on their furnishing of bail/surety bonds to the satisfaction of the arresting officer/investigating officer. The petitioner(s) shall also abide by the conditions as specified under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) of 2023. Photocopy of this order be placed on the file of connected case.” 4. Continuing his submissions, learned counsel for the petitioner contends that in compliance of the order dated 13.05.2026, passed by this Court, petitioner has joined the investigation and has fully co-operated. Learned State counsel on instructions, confirms the said averment made by learned counsel for the petitioner of joining the investigation by the petitioner, and submits that as of now, custodial interrogation of the petitioner is not required for the purpose of investigation. 6. Heard learned counsel for the parties. 7. Since, petitioner has already joined the investigation and custodial interrogation is no more required; ad-interim bail order dated 13.05.2026, passed by this Court is hereby made absolute. Accordingly, present petition is allowed. 8. However, petitioner shall continue to join the investigation as and when required to do so and abide by all the terms and conditions laid down under Section 482(2) of BNSS, 2023. 9. Accordingly, petition stands disposed of.
