…for the State. Mr. Ujjwal Luksom Mr. Sandipan Das …for the de facto complainant. 1. The petitioner says that he has been falsely implicated. His daughter-in-law filed a complaint against the present complainant’s family regarding alleged extortion of money. The present complaint is a counterblast. He prays for anticipatory bail. 2. Learned Counsel for the State and the de facto complainant oppose the prayer. 3. I have seen the statement of the victim girl recorded under Section 183 of Bharatiya Nagarik Suraksha Sanhita, 2023 (corresponding to Section 164 of the Criminal Procedure Code,
2 1973). Prima facie it does not appear that the allegation of rape is borne out. The medical report discloses no injury either on the victim’s private parts or anywhere else. 4. On an overall assessment of the facts and circumstances of the case, I am of the opinion that immediate custodial interrogation of the petitioner may not be necessary, so long as he fully co- operates with the Investigating Officer. 5. Accordingly, in the event of arrest, the petitioner, namely, SRI GURUDEB ROY@GURUDEB RAY shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand), with two sureties of Rs.5,000/- (Rupees Five Thousand) each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Alipurduar and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973 / Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023, until further orders and on further condition that the petitioner shall meet the Investigating Officer of this case as and when called for, until further orders. Within three days from date the petitioner shall go and meet the Investigating Officer of this case. 6.
In case the petitioner fails to adhere to any of the conditions stipulated above, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 7. The application for anticipatory bail being CRM(A)/580/2026 is accordingly disposed of. 3
