Advocate Hon’ble Shri Bibhu Datta Guru, Judge Order on Board 02.09.2026 1. This MCC is filed for restoration of WPS No.4035/2026, which came to be dismissed for want of prosecution vide order dated 06.08.2026. 2. Learned counsel for the applicant submits that the counsel for the applicant inadvertently overlooked WPS No.4035/2026 while perusing the cause list and, consequently, neither the counsel nor his office was aware that the matter was listed for hearing. As a result, learned counsel could not appear when the matter was taken up. It is further submitted that it was only when the counsel sought to move an application for urgent hearing that it came to his knowledge that the writ petition had already 3 been dismissed for want of prosecution. It is, therefore, submitted that the non-appearance was neither intentional nor deliberate and, accordingly, It is, therefore, prayed that WPS No.4035/2026 be restored to its original number. 3. I have heard learned counsel for the applicant and perused the material available on record. 4. Considering the facts and circumstances of the case and the explanation furnished by the applicant, this Court is satisfied that sufficient cause has been shown for restoration of WPS No.4035/2026. The non-appearance of learned counsel appears to be bona fide and inadvertent. 5. Accordingly, this MCC is allowed. The order dated 06.08.2026, whereby WPS No.4035/2026 was dismissed for want of prosecution, is recalled. WPS No.4035/2026 is restored to its original number. 6.
