p. 1 IN THE HIGH COURT OF ORISSA AT CUTTACK ABLAPL No. 162 of 2026 Gobinda Champati …. Petitioner Mr. A. Pattanaik, Advocate -Versus- State of Odisha …. Opposite Party Smt. S. Mohanty, ASC CORAM: MR. JUSTICE R.K. PATTANAIK Order No. ORDER 12.01.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition under Section 482 BNSS is filed seeking pre-arrest bail of the petitioner in connection with G.R. Case No.868 of 2025 pending in the file of learned J.M.F.C (Cognizance Taking), Khurda arising out of Jankia P.S. Case No.414 of 2025 on the grounds stated. 3. A case is registered upon receiving the FIR i.e. Annexure-1 with the allegation that some unknown culprits committed theft of gold ornaments and other items from the residence of the informant and in that connection, the petitioner apprehends arrest. It is submitted to the Court that the petitioner had already approached this Court in ABLAPL No.12886 of 2025 as at Annexure-2 and therein, while directing release, one of the conditions imposed was to verify the criminal antecedent of similar nature. It is submitted that the petitioner is having one more antecedent but not of similar nature. It is informed to p. 2 the Court that despite such an order as per Annexure-2, the plea for bail upon surrender was not entertained by the court concerned. Recorded the objection of the State. Considering the above facts and earlier order of this Court in ABLAPL No.12886 of 2025, the Court though not inclined to allow grant pre-arrest bail but directs the petitioner to surrender before the Court of learned J.M.F.C (Cognizance Taking) Khurda in connection G.R. Case No.868 of 2025 and in the event, he surrenders within a fortnight from today shall be released on bail upon furnishing bail bond of Rs.30,000/- (rupees thirty thousand) with one solvent surety for the like amount with such other conditions imposed by the court concerned as deemed just and proper and in the facts and circumstances of the case. 4. As a result, the ABLAPL is disposed of. 5. Issue urgent certified copy of this order as per rules. (R.K. Pattanaik) Judge Rojina Designation: Junior Stenographer
