Service report filed by the State be kept with the records. 2. In spite of service, nobody appears for the defacto complainant/victim. 3. The allegation against the petitioner is of false promise to marry and rape. I find from the FIR as also from the statement of the victim lady recorded under Section 180 of the BNS (161 of the Code of Criminal Procedure) that admittedly there was a long standing love affair between the petitioner and the victim. I also see that the victim is about 24 years old and the petitioner is about 25 years old. 4. Given the nature of allegations and considering the facts and circumstances of the case, I am of the opinion that
2 immediate custodial interrogation of the petitioner may not be necessary so long as he fully cooperates with the Investigating Officer. 5. Accordingly, in the event of arrest, the petitioner, namely Litan Barman, shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that the petitioner shall report to the Investigating Officer once in a fortnight and also as and when called for until further orders. 6. In case the petitioner fails to adhere to any of the conditions mentioned hereinabove or in Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 7.
The application for anticipatory bail being CRM (A) 605 of 2026 is disposed of. 8. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. ( Arijit Banerjee, J. )
