JUSTICE SANJEEV KUMAR, JUDGE HON’BLE MR. JUSTICE YASH PAUL BOURNEY, JUDGE ORDER 29.09.2026 1. Learned counsel, appearing for the appellant, fairly submits that, after filing of this appeal and the rejection of bail application by the learned trial Court vide order dated 31.12.2024, twenty more witnesses have been examined in the trial and, therefore, the situation has undergone a substantial change. She would submit that the witnesses now examined have not deposed anything substantial against the appellant and, therefore, the appellant would be entitled to file a fresh bail application, in view of the changed circumstances. 2. In view of the submissions made by learned counsel for the appellant, this appeal is dismissed as withdrawn with liberty to the appellant to approach the learned trial Court by way of fresh application. Needless to say that, in case, such an application is filed, the same shall be considered afresh on the basis of evidence on record and without being prejudiced by the observations made in the impugned order.
