The applicant has preferred this First Bail Application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of regular bail, as he has been arrested in connection with Crime No. 328/2025, registered at Police Station – Mana Camp, Raipur, District – Raipur (C.G.) for the offence punishable under Sections 309(6) and 310(2) of the BNS. 2. It has been pointed out by learned State counsel that the bail application of the co-accused has been rejected by the trial Court only for the offence punishable under Section 309(6) of the BNS, and the instant bail application has been filed for the offence punishable under Sections 309(6) and 310(2) of the BNS, to RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 which learned counsel for the applicant submits that Section 310(2) of BNS was added after filing of the chargesheet, but learned State counsel further contends that the bail application has not been rejected by the trial Court for offence under Section 310(2) of the BNS. 3. In view of the above, the instant bail application is rejected on this ground alone, with liberty to the applicant to file afresh after getting the bail rejected by the trial Court for offence under Section 310(2) of BNS, if so requires. 4.
