Ms. Rajyashree Ghosh, ……for the State. 1. The petitioner says that he has been falsely implicated. The de facto complainant used to be a domestic help at the petitioner’s house. The petitioner’s father had to lodge an FIR against this de facto complainant and her husband, having been assaulted by them. This was on June 13, 2026. As a counterblast, the de facto complainant has made this false complaint. 2. Learned State counsel produces the case diary and opposes the prayer for anticipatory bail. 3. I have gone through the material-on-record. Prima facie, the possibility of false implication cannot be ruled
2 out. I see that the complaint lodged by the petitioner’s father is dated June 13, 2026. Two days’ later the present criminal complaint was lodged. There was a delay of more than three months in lodging the complaint. 4. Considering the facts and circumstances of the case, I am of the view that immediate custodial interrogation of the petitioner may not be necessary so long as he co- operates with the Investigating Officer. 5. Accordingly, in the event of arrest, the petitioner, namely Sanjeev Choudhary shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that he shall meet the Investigating Officer of this case as and when called for. 6.

In case the petitioner fails to adhere to any of the conditions mentioned in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 3
7. The application for anticipatory bail, being CRM (A) 595 of 2026, stands disposed of. 8. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. (Arijit Banerjee, J.)
