P.P. …...... 02/ 25.02.2026: This bail application has been filed under Sections 483 & 484 of BNSS, 2023 wherein, prayer has been made for grant of bail as they are in custody for allegedly committing offence punishable under Sections 338, 336(2), 340(2), 341(3), 274, 275, 317(5), 3(5) of the Bharatiya Nyaya Sanhita and under Section 47(a) of Excise Act. 2. Heard, learned counsel for the petitioners, learned counsel for the State and have also gone through the impugned order. 3. Learned A.P.P. opposes the prayer for bail. 4. Petitioners were apprehended on the spot on the vehicle. There is allegation that spurious foreign liquors were being transported. From the possession of these petitioners’ foreign liquors, stickers and bottle caps were recovered which suggest that they are involved in transporting and packaging of duplicate foreign liquors. 5. Considering the aforesaid fact and the fact that the petitioners have been apprehended on spot with the materials, at this stage, I am not inclined to grant privilege of bail to these petitioners. Accordingly, the prayer for bail of these petitioners in connection with Chauparan P.S. Case No.323 of 2025, pending in the Court of learned Judicial Magistrate, 1st Class, Hazaribag stands rejected.
