JUSTICE JAYANT BANERJI) The contempt petition is filed seeking to initiate contempt proceedings against the accused for not having complied with the directions issued by this Court in Writ Petition No. 11903/2020 on 28.03.2025. 2. The order of the Writ Court reads as follows:- “ORAL ORDER Learned counsel for the petitioner and respondents after arguing the matter for some time submit in unison that in terms of the resolution dated 27.02.2023 passed by the respondent-BDA vide Subject No.65/2023, respondent –BDA has resolved that in terms of Section 38 of the Bangalore Development Authority Act, 1976, the petitioner herein namely, Smt.G.A.Sumangala would be allotted an alternate - 3 - HC-KAR CNR: KAHC010119002026 NC: 2026:KHC:43269-DB CCC No. 214 of 2026 site measuring 30 X 40 ft., within the J.P.Nagar 8th Phase Layout formed by the respondent-BDA subject to petitioner herein executing a release/relinquishment deed in respect of site bearing No.547B. 2. Learned counsel for the petitioner submits that the petitioner would, in the event of respondent-BDA allotting alternate site and confirming the number and identity of the site, do the requisite by executing the release deed in favour of the respondent -BDA. 3. In response, learned counsel for the respondent-BDA submits that necessary steps would be taken to identify and allot alternate site as per the resolution referred to above and requisites will be done including executing deeds of conveyance in favour of the petitioner. 4. Submission is taken on record. 5. In that view of the matter, petition is disposed of with a direction to the respondent-BDA to implement the resolution as noted above, within an outer limit of eight (8) weeks from the date of receipt of certified copy of this order. 6. Needless to clarify simultaneously on execution of necessary documents/deeds by BDA in favour of the petitioner, petitioner shall also execute deeds of relinquishment relinquishing the - 4 - HC-KAR CNR: KAHC010119002026 NC: 2026:KHC:43269-DB CCC No. 214 of 2026 site bearing No.547B, in favour of the respondent -BDA.” 3. An affidavit has been filed today in Court by Sri. Ajay Kumar M., Advocate, on behalf of the accused. It is stated therein, inter alia, that a formal allotment of the site has taken place by issuance of allotment letter dated 01.08.2026. An unconditional apology has also been proffered by the accused. The learned counsel for the complainant, however, states that the order of the Writ Court had directed simultaneous execution of relinquishment deed and also sale deed in respect of the site sought to be relinquished and the allotted site. It is therefore submitted that right to revive the contempt petition be reserved to the complainant should there be any default in complying with the order of the Writ Court. 4. Learned counsel for the Accused states that subject to the relinquishment deed being executed by the complainant, the sale deed in respect of the allotted site shall be executed simultaneously, that is to say on the same day. It is directed, that exercise shall be completed by both the parties within a period of 06 weeks and co-operation of both the parties is - 5 - HC-KAR CNR: KAHC010119002026 NC: 2026:KHC:43269-DB CCC No. 214 of 2026 required. In case there is any default in complying with the order of the Writ Court, it shall be open for the counsel for the complainant to move an application for revival of the instant contempt petition. 5.
