Heard Mr. Vivekanand Samaddar, learned counsel for the applicants as well as Mr. Jitendra Shrivastava, learned Government Advocate, appearing for the State. 2. The present MCC has been filed for modification of the order dated 11.08.2026 passed in WPCR No.460 of 2026 with the following reliefs:- “a) clarify/direct that the liberty granted to the Petitioners vide order dated 11.08.2026 in WPCR No. 460 of 2026 includes the liberty to obtain/receive back from the Registry the certified copies of the documents/annexures 3 originally filed by the Petitioners in the said writ petition for the purpose of annexing the same with the separately constituted proceedings to be instituted in accordance with law; b) direct the Registry/concerned section to return to the Petitioners/their learned counsel the original certified copies of the documents/annexures filed with WPCR No. 460 of 2026, after retaining photocopies/scanned copies/office copies thereof on the record, if so required; c) permit the Petitioners to use and annex the said certified copies in the fresh writ petition(s)/proceeding(s) proposed to be filed pursuant to the liberty granted by this Hon'ble Court vide order dated 11.08.2026; and d) pass any other order or direction which this Hon'ble Court may deem fit and proper in the interest of justice.” 3. Learned counsel appearing for the applicants submits that the present application has been preferred seeking appropriate clarification/modification of the order dated 11.08.2026 passed in W.P. (Cr.) No.460 of 2026, whereby the petition was dismissed with liberty to the petitioners to institute fresh and separately constituted proceedings challenging any particular complaint case, cognizance order, order framing charge, FIR, SEBI order or any other specific proceeding or action, in accordance with law. It is submitted that the certified copies of various relevant orders and documents had already been filed along 4 with the aforesaid writ petition and form part of the record. Since the applicants are now required to avail the liberty granted by this Court by instituting appropriate fresh proceedings, they seek return of the original certified copies of the documents/annexures filed in the earlier proceedings, subject to such conditions as may be imposed by the Court, so as to avoid unnecessary duplication and expenditure in obtaining fresh certified copies. 4. Learned State counsel appearing for the respondents submits that he has no objection to the prayer made by learned counsel appearing for the applicants. 5. In view of the aforesaid submissions and considering the nature of the prayer made in the present MCC, the same is disposed of. The Registry is directed to return to the applicants/their learned counsel the original certified copies of all the documents/annexures filed along with W.P.(Cr.) No.460 of 2026, after retaining photocopies/scanned copies/office copies thereof on the record, if so required. The applicants shall be at liberty to use and annex the said certified copies in the fresh proceedings proposed to be instituted pursuant to the liberty granted by this Court vide order dated 11.08.2026, in accordance with law. 6.
