Ms. Anamika Bhat, Adv. … For Opposite Party No.2. 1. The learned counsel for the petitioners has submitted that there is a case and counter-case between the concerned parties. In this case, the petitioners are the accused in connection with Pradhannagar Police Station Case No.518 of 2026 dated 17-07-2026 under Sections 126(2)/117(2)/ 303(2)/318(4)/351(2)(3)/61(2) of the Bharatiya Nyaya Sanhita, 2023. The learned counsel has further submitted that this revisional application has been filed praying for quashing of the aforesaid criminal proceedings which are now pending before the learned Additional Chief Judicial Magistrate, Siliguri, District Darjeeling, as the parties concerned have come to settle the matter amicable outside the Court. 2. The counter-case against these petitioners being Pradhannagar Police Station Case No.515 of 2026 dated 16- 07-2026 under Sections 126(2)/117(2)/303(2)/ 351(2)(3)/61(2) of the Bharatiya Nyaya Sanhita, 2023 has also been compromised and relevant petition for quashing was also filed in the said counter-case. 2 3. The learned counsel for the defacto complainant is present. She has also submitted that the matter has been settled between the parties. 4. However, it appears that there are some offences which are non-compoundable. However, as the matter has been settled between the parties and as the injury report does not show that there were grievous injuries caused to any of the injured persons, I am inclined to allow the prayer made on behalf of the present petitioners. Accordingly, Pradhannagar Police Station Case No.518 of 2026 dated 17-07-2026 under Sections 126(2)/117(2)/ 303(2)/318(4)/ 351(2)(3)/61(2) of the Bharatiya Nyaya Sanhita, 2023 and corresponding proceedings thereto are hereby quashed. 5. The revisional application and the connected application are, accordingly, disposed of. 6. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. 7. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities. (Apurba Sinha Ray, J.)
