In the matter of : Rahul Ali @ Ruhul Ali & Anr. .... Petitioners. Mr. Subhadip Biswas, Ms. B. Bose, … For the Petitioners. Mr. Avrajyoti Das, Mr. U. Lama, Mr. S. Barman, … For the State. 1. The allegation is under Sections 80/85 of the BNS (corresponding to Sections 498A and 304B of the IPC). The petitioner no. 1 is the brother in law and the petitioner no. 2 is the mother in law of the victim lady who committed suicide. The petitioners say that they have no role to play in the alleged crime. Charge sheet has already been submitted. The father in law of the victim lady has been granted anticipatory bail by a coordinate Bench by an order dated July 23, 2026. They pray for anticipatory bail. 2. Learned State Advocate opposes the prayer. He shows me the material in the case diary. 3. From the case diary I see that the principal accused is the husband of the victim lady, i.e., Rubel Ali. There is a passing
2 reference to the other members of the husband’s family. I see that the present petitioners stand more or less on the same footing as the father in law of the victim who was granted anticipatory bail by a coordinate bench. 4. Hence, I am inclined to allow this application so long as the petitioners, in case of further investigation, cooperate with the Investigating Officer. 5. Accordingly, in the event of arrest, the petitioners, namely Rahul Ali @ Ruhul Ali and Rupchhana Begam, shall be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of like amount each, one of whom must be local, to the satisfaction of the ACJM, Alipurduar and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that the petitioner no.
1 shall report to the Inspector in charge of the concerned police station once in a fortnight and also as and when called for until further orders. The petitioner no. 1 shall go and meet the Inspector in Charge of the concerned police station within three days from date. 6. In case the petitioners fail to adhere to any of the conditions mentioned hereinabove or in Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 7. The application for anticipatory bail being CRM (A) 669 of 2026 is disposed of. 3
