INDIRESH ORAL ORDER In this petition, the petitioner is challenging the order dated 21st September, 2023 (Annexure-E) passed by the respondent No.2 in Case No.RA(NE):236/2023 and order dated - 3 - HC-KAR CNR: KAHC010382132025 NC: 2026:KHC:40584 WP NO.18026 OF 2025 21st February, 2025 (Annexure-F) passed by the respondent No.1 in Revision Petition No.22/2024. 2. Heard Sri. Venkata Reddy C.M., learned counsel appearing for the petitioner and Sri. Spoorthy Hegde N., learned High Court Government Pleader appearing for respondents 1 to 5; and Sri. Raghu H., learned counsel appearing for the respondent No.6. 3. Having heard the learned counsel appearing for the parties and on careful consideration of the impugned orders, it is forthcoming that the father of petitioner has purchased the land to an extent of 35 guntas in land bearing Survey No.13 of Bommanahalli Village, Kasaba Hobli, Nelamangala Taluk from one Karivaradaiah. It is forthcoming from the writ petition that, out of total extent of 35 guntas, 20 guntas of the land has been sold by the father of the petitioner in favour of the respondent No.6 and further 7 guntas of land was acquired by the National Highway Authority for formation of Road. Therefore, I am of the view that the land to an extent of 8 guntas is remained with the petitioner. In that view of the matter, I am of the considered opinion that the respondent- - 4 - HC-KAR CNR: KAHC010382132025 NC: 2026:KHC:40584 WP NO.18026 OF 2025 Authorities have failed to consider the fact that, out of total extent of 35 guntas of the land, 8 guntas of the land is with the petitioner after 20 guntas of land sold in favour of the respondent No.6 as well as 7 guntas of land acquired by the National Highway Authority of India. Hence, the finding recorded by both the respondent-Authorities requires to be set- aside. Accordingly, I pass the following: O R D E R (i) Writ Petition allowed; (ii) Order dated 21st September, 2023 (Annexure-E) passed by the respondent No.2 in Case No.RA(NE):236/2023 and order dated 21st February, 2025 (Annexure-F) passed by the respondent No.1 in Revision Petition No.22/2024 are hereby set-aside; (iii) The respondent No.3 is directed to enter the name of the petitioner in the revenue records to an extent of 8 guntas in Survey No.13 of Bommanahalli Village, Kasaba Hobli, Nelamangala Taluk within a period of two months from the date of receipt of this order; - 5 - HC-KAR CNR: KAHC010382132025 NC: 2026:KHC:40584 WP NO.18026 OF 2025 (iv) The mutation order in M.R. No.T6/2023-24 made in respect of National Highway-48 to an extent of 15 guntas is hereby set-aside; consequently, the competent authority is directed to show 7 guntas of land to the National Highway-48 in the RTC extracts.
