1. The allegation against the petitioner is that he, as a part of a mob, assaulted the victim. There is no role specifically attributed to him. The petitioner prays for pre arrest bail.
2. I have seen the injury report. The injury appears to be simple.
3. On an overall
consideration of the
facts and circumstances of the case, I am of the opinion that immediate custodial interrogation of the petitioner may not be necessary so long as he fully cooperates with the Investigating Officer.
4. Accordingly, in the event of arrest, the petitioner, namely Biplab Ghosh shall be released on bail upon furnishing
2 a bond of Rs.10,000/-, with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that he shall report to the Investigating Officer within three days from date and as and when called for, until further orders.
5. In case the petitioner fails to adhere to any of the conditions mentioned in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court.
6. CRM (A) 650 of 2026 stands disposed of.
7. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
