JUSTICE S VISHWAJITH SHETTY ORAL ORDER Accused No.2 in Crime No.150 of 2026 registered by Viveknagar Police Station, Bengaluru City for the offences punishable under Section 109(1), 118(1), 351(2), 352 read with Section 3(5) of BNS, 2023 and Section 25(B)(b) of Arms Act, 1959, is before this Court in this petition filed under Section 483 of BNSS, 2023 seeking regular bail. 2. Heard the learned counsel for the parties. 3. FIR in crime No.150 of 2026 registered by Viveknagar Police Station, Bengaluru City for the aforesaid offences against Naga and two others, based on the first information dated 21.06.2026 received from Karthik, who - 3 - HC-KAR CNR: KAHC010463262026 NC: 2026:KHC:42723 CRL.P No. 10015 of 2026 is the brother of the injured victim. During the course of investigation, the petitioner who is arraigned as accused No.3 in the FIR, was arrested on 21.06.2026 and remanded to judicial custody. His bail application filed before the jurisdictional Sessions Court in Crl.Misc.No.6256/2026 was rejected on 03.07.2026. Therefore, he is before this Court. 4. Perusal of the first information would go to show that, on the intervening night of 20.06.2026 and 21.06.2026 at about 03.00 a.m., injured victim/Manoj had gone out of his house with his dog. At that time, two boys, who had parked their scooter on the road side, asked him to give them matchbox and one amongst the said two boys was the petitioner herein. It appears that thereafter, there was a quarrel between the said two boys and the victim/Manoj and subsequently, accused No.2/Darshit was summoned to the said spot by the aforesaid two boys. Thereafter, accused No.1 had allegedly assaulted the victim/Manoj with a helmet on his head and back and - 4 - HC-KAR CNR: KAHC010463262026 NC: 2026:KHC:42723 CRL.P No. 10015 of 2026 accused No.2 had allegedly assaulted the victim/Manoj with a machete on his head and caused injuries. Allegation against the petitioner, who is arraigned as accused No.3 in the FIR, is that he had kicked Manoj along with the other accused persons. The victim/Manoj has suffered five injuries in the incident in-question and 4 out of 5 injuries are said to be simple injuries and one is said to be a grievous injury, which is a fracture of the parietal bone. Allegation of assaulting the victim on his head with a helmet is found in the FIR as against Accused No.1. Petitioner, who has no other criminal antecedents, is in custody from 21.06.2026. Major portion of investigation is completed. 5. Under the circumstances, I am of the opinion that the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively, subject to appropriate conditions. The petitioner is directed to be enlarged on bail in Crime No.150 of 2026 registered by Viveknagar Police Station, Bengaluru City for the offences punishable under Section 109(1), 118(1), 351(2), 352 read with Section 3(5) of BNS, 2023 and Section 25(B)(b) of Arms Act, 1959, subject to the following conditions: a) The petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; - 6 - HC-KAR CNR: KAHC010463262026 NC: 2026:KHC:42723 CRL.P No. 10015 of 2026 d) The petitioner shall not involve in similar offences in future; e) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
