In re: An application for anticipatory bail under Section 438 of the Code of Criminal Procedure/Section 482 of the BNSS in connection with Sahebganj Police Station Case No. 722 of 2025 dated 30.12.2025 under Sections 329(4)/126(2)/117(2)/3(5) of the BNS, 2023 and Sections 4/18 of the POCSO Act. - A n d -
In the matter of : Sabuj Das @ Basudeb Das @ Sabuj .... Petitioner. Mr. Rounak Ghosh … For the Petitioner. Mr. Avrajyoti Das, Mr. G. Ghosh, Mr. D. Rai, … for the State.
Ms. Somdutta Patra … for the defacto complainant.
1. The petitioner says that he has no role to play in the alleged crime. The present complaint is a counter blast to an earlier complaint lodged by the petitioner against the present complainants. Charge sheet has been filed upon completion of investigation. He prays for pre-arrest bail.
2. From the material in the case diary that the State Advocate has shown me, there appears to be prima facie incriminating material against the petitioner.
3. Learned Advocate for the defacto complainant also opposes the prayer vehemently.
4. Considering the material in the case diary and the nature of the allegations, I am not inclined to allow this application for anticipatory bail.
