The revision petitioner has filed this petition under Section 397 read with Section 401 of the Code of Criminal Procedure to set aside the order dated 06.01.2016 passed by the learned II Additional Session Judge, Mysuru in Crl.A.No.6/2014. 2. I have perused the order dated 02.02.2026 passed by the Co-ordinate Bench in Crl.R.P.No.513/2016 c/w Crl.R.P.No. 1017 of 2023, wherein the respondent filed the said revision petition challenging the order dated - 3 - HC-KAR CNR: KAHC010431862026 NC: 2026:KHC:45020 CRL.RP No. 1029 of 2026 06.01.2016 passed by the learned II Additional Sessions Judge, Mysuru in Crl.A.No.393/2013. 3. The co-ordinate bench of this court, vide order dated 02.02.2026, held at paragraph No.14, which reads as under: 14. "Crl.R.P.No.513/2016 is partly allowed. The order dated 28.11.2013 passed in Crl.Misc.No.100/2012 which is modified in Crl.A.No.393/2013 enhancing the monthly maintenance from Rs.10,000/- to Rs.11,000/- per month is confirmed, and the matter is remanded to the trial court to consider the application filed by the wife in so far as it relates to providing her suitable residential accommodation. Parties are at liberty to lead fresh evidence before the trial court." 4. In the present revision petition, the revision petitioner has sought to set aside the order dated 06.01.2016 passed by the learned II Additional Sessions Judge, Mysuru. The Co-ordinate bench allowed Crl.R.P.No. No.513/2016 in part, filed by the present respondent, and remitted the matter to the trial court to consider the - 4 - HC-KAR CNR: KAHC010431862026 NC: 2026:KHC:45020 CRL.RP No. 1029 of 2026 application filed by the wife /respondent insofar it relates to providing her suitable residential accommodation. 5. Hence, there is no merit consideration made out in this criminal revision petition, as the co-ordinate bench has passed the order which has attained finality insofar as the order dated 06.01.2016 is concerned.
