Mr. Aditi Shankar Chakraborty, Ms. Jena Chowdhury, …for the de facto complainant. 1. The allegation is of false promise to marry. The petitioner says that he has been falsely implicated. He had a consensual physical relationship with the victim lady. The same having come to light, this false complaint has been lodged. The victim is a married lady with two children. 2. Learned advocates for the State and the de facto complainant oppose the prayer for pre-arrest bail. 2 3. I have considered the material in the case diary including the statement of the victim recorded under Section 164 Cr.P.C. as also the medical report. 4. On an overall assessment of the facts and circumstances of the case, I am of the view that immediate custodial interrogation of the petitioner may not be necessary so long as he co-operates with the Investigating Officer. 5. Accordingly, in the event of arrest, the petitioner, namely Karim Rahaman shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the arresting officer and shall abide by the conditions laid down in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023 until further orders and on further condition that he shall meet the Investigating Officer of this case as and when called for until further orders. Within three days from date the petitioner shall go and meet the Investigating Officer of this case and on further condition that the petitioner shall remain within the jurisdiction of Kotwali Women Police Station, Coochbehar until further order. 6. In case the petitioner fails to adhere to any of the conditions mentioned in Section 438(2) of the Code of Criminal Procedure, 1973/Section 482(2) of the 3 Bharatiya Nagarik Suraksha Sanhita, 2023, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 7. The application for anticipatory bail, being CRM (A) 639 of 2026, stands disposed of. 8. All parties shall act in terms of server copy of the order downloaded from the official website of this Court.
