CRM (A) 591 of 2026
In Re: An Application for Anticipatory Bail under Section 438 of the Code of Criminal Procedure, 1973/Under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Haldibari Police Station Case No. 84 of 2026 Dated 17.05.2026 under Sections 64/303(2)/351(2)/3(5) of the B.N.S. 2023
And In the matter of : Manna Shah @ Mannaj Shah
……Petitioner.
Mr. Subhasis Mishra
Mr. Rounak Ghosh ……for the Petitioner.
Mr. Avrojyoti Das, ld. APP
Mr. Urgen Lama,
Mr. Supritam Nag ……for the State.
1. The petitioner prays for anticipatory bail. He says that he has been falsely implicated. There was an affair between him and the defacto complainant. When the same came to light, this false complaint has been lodged.
2. The State opposes the prayer for pre arrest bail.
3. I have seen the statement of the defacto complainant recorded under Section 164 Cr.P.C. She clearly narrates how she was abducted and threatened with the murder of her four year old child to persuade her to have physical relationship with the petitioner.
4. Considering the facts and circumstances of the case, I am not inclined to allow this application.
5. CRM (A) 591 of 2026 stands dismissed.
