Adv., Mr. Raj Kumar Mitra, Adv., Mr. Debabrata Rai, Adv. … For the State. 1. The learned counsel for the petitioner has submitted that the petitioner is in custody for about 350 days. It is further submitted that the petitioner is aged about 65 years. There is no chance of an early conclusion of the trial since the charge is yet to be framed. The petitioner may be enlarged on bail on any condition. 2. The learned counsel for the State opposes the prayer for bail vehemently. According to her, there are sufficient incriminating materials against the present petitioner. 3. I have gone through the materials on record. The allegations are very serious. The victim is aged about 14 years and she became pregnant at the instance of the present petitioner, who is 65 years old. It is also found that the petitioner administered termination pill upon the victim to terminate the pregnancy. There are incriminating materials 2 against the present petitioner in the Case Diary. As such, I am not inclined to grant bail to the petitioner. 4. The application for bail is, thus, rejected. 5. All parties shall act on the server copies of this order duly downloaded from the official website of this Court. 6. Criminal Section is directed to supply certified copies of this order to the parties, if applied for, upon compliance of all necessary formalities. (Apurba Sinha Ray, J.)
