Heard Sri. Srinatha B.V., learned counsel appearing for the petitioners; Smt. Waheeda M.M., learned High Court Government Pleader appearing for respondent No.1 and Smt. Keerthi Krishna Reddy, learned counsel appearing for respondent No.2. 3. Facts, in brief, germane are as follows: The second respondent is the complainant. The petitioners are the family members of accused No.1 and the allegation principally is against accused No.1, while accused Nos.2 to 8 are all family members of the petitioner/accused - 5 - HC-KAR CNR: KAHC010396372026 NC: 2026:KHC:43153 CRL.P No. 8372 of 2026 No.1. The first petitioner and second respondent/complainant are said to be acquaintances and the two are already married and are having children. The allegation springs from the complaint of the second respondent that the complainant is stalking, criminally intimidating, voluntarily restraining the movement of the complainant and has assaulted her, as well. The other members of the family have not taken any steps even after complaining and they have instigated the first petitioner to behave in the manner that he has behaved with a lady, the complainant. This becomes a crime in crime No.397/2025. The Police after investigation have filed a charge sheet against all the petitioners for the aforesaid offences. The filing of the charge sheet has driven the petitioners to this Court in the subject petition. 4. The learned counsel appearing for the petitioners Sri. Srinatha B.V., submit that it is a case and a counter case. The first crime is registered by the petitioners in crime No.396/2025 followed by the crime registered by the second respondent/complainant in crime No.397/2025. All the allegations are against accused No.1. 5. The learned counsel appearing for the complainant Smt. Keerthi Krishna Reddy would vehemently refute the submission in contending that the acts of the first petitioner should not be pardoned. The acts of the other petitioners also should not be pardoned, but the allegation against them is only with regard to instigation or not taking action against the son for behaving in the manner that he has behaved. The learned counsel would submit that the petition be dismissed in its entirety. 6. The learned High Court Government Pleader would also toe the lines of the learned counsel appearing for the complainant. 7. He has dragged the complainant throughout, disrobed her and has assaulted her. If the two are read in tandem, it is ununderstandable as to how in such a case qua accused No.1, there can be interdiction or obliteration of the proceedings as contented by the learned counsel appearing for the complainant. If interference qua accused No.1 would happen at the hands of this Court, it would amount to putting a premium on the acts of the first petitioner. Therefore, the first petitioner must face trial is the prima facie opinion of this Court. 10. Insofar as the other petitioners are concerned, the family members of accused No.1, while the allegations primarily galore against accused No.1, sprinkling few is made against accused Nos.2 to 8, who are members of the family of accused No.1. The allegations against them is only instigation - 12 - HC-KAR CNR: KAHC010396372026 NC: 2026:KHC:43153 CRL.P No. 8372 of 2026 or not stopping accused No.1 in behaving in the manner in which he has done despite it being brought to the knowledge of the family members. Barring this, there is no allegation against them that would necessitate a trial for the aforesaid offences against them, as it is only abatement, which is bleak. In that light, the proceedings against accused Nos.2 to 8 cannot be permitted to be continued. The petition thus succeed in part. 11. For the aforesaid reasons, the following: ORDER (i) The criminal petition is allowed-in-part. (ii) The criminal petition insofar as accused No.1 is concerned, the criminal petition stands dismissed and the charge sheet stands sustained. The accused No.1 has to come out clean in a full blown trial.
