Charge-sheet no.183/2023 dated 28.02.2023 under Section 305 of the Indian Penal Code, 1860. And In the matter of: - MITHU MANDAL …petitioner. Ms. Esha Acharya Ms. Ipsita Saha …for the petitioner. Mr. Avrojyoti Das, Ld. APP Mr. Supritam Nag …for the State. 1. The allegation is under Section 305 of the Indian Penal Code, 1860. A boy, about 14 years of age, committed suicide. It is alleged that the petitioner abetted such suicide. 2. I have considered the facts and circumstances of the case and the material on record. I am of the view that immediate custodial interrogation of the petitioner may not be necessary, so long as he co-operates with the Investigating Officer in case of further investigation. 3. Accordingly, in the event of arrest, the petitioner, namely MITHU MANDAL shall be released on bail upon furnishing a bond of Rs.10,000/- (Rupees Ten Thousand), with two sureties of Rs.5,000/- (Rupees Five Thousand) each, one of whom must be local, to the satisfaction of the arresting Officer and shall abide by the conditions laid down in Section 438(2) of the Code 2 of Criminal Procedure, 1973 / Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, 2023, until further orders and on further condition that the petitioner shall meet the Investigating Officer of this case as and when called for, until further orders. Within three days from date the petitioner shall go and meet the Investigating Officer of this case. 4. In case the petitioner fails to adhere to any of the conditions stipulated above, the learned Court below shall be entitled to cancel the anticipatory bail without further reference to this Court. 5. The application for anticipatory bail being CRM(A)/651/2026 is accordingly disposed of. 6. Criminal Section is directed to make available certified copies of this order to the parties, if applied for, upon compliance with all requisite formalities. (Arijit Banerjee, J.)
