The applicant has preferred this First Bail Application under Section 483 of The Bharatiya Nagarik Suraksha Sanhita (BNSS) for grant of regular bail, as he has been arrested in connection with Crime No. 10/2026, registered at Police Station Hirri, District – Bilaspur (C.G) for the offence punishable under Sections 420 of the Indian Penal Code (IPC). 2. According to the prosecution's case, the complainant, namely Ambika Prasad Bhardwaj, filed a complaint before the police against the present applicant about offense of cheating. However, the FIR was not registered, then he filed a complaint case before the learned JMFC, Bilha. Pursuant to the directions from the Ld. Court under Section 175(3) of the Bharatiya Nagarik Suraksha Sanhita (BNSS), an FIR has been lodged and investigation was initiated against the present RAJSHEKHAR SONI Digitally signed by RAJSHEKHAR SONI 2 applicant and subsequently a Final Report has been submitted. As per the FIR, on 04.07.2023 the applicant with dishonest intention, induced the complainant by falsely promising to secure employment in the Family Court, Raipur for the complainant's son and nephew. The complainant and his son transferred money to the present applicant through mobile banking and also paid a portion in cash. It is alleged that the present applicant is alleged to have dishonestly obtained a total amount of Rs. 26,30,000/- from the complainant and his family members, thus the present applicant has been prosecuted in the present case. 3. It has been argued by the learned counsel for the applicant that the applicant is innocent and he has been falsely implicated. It is submitted that the applicant is in jail since 20.02.2026, conclusion of the trial is likely to take some time. Therefore, he prays for grant of regular bail to the applicant. 4. On the other hand, learned State counsel opposes the bail application of the present applicant and submits that the present applicant is alleged to have dishonestly obtained a total amount of Rs. 26,30,000/- from the complainant to secure employment in the Family Court, Raipur for the complainant's son and nephew, and there are a total of 4 criminal antecedents of the applicant out of which 2 are still pending, therefore, the present applicant is not entitled for grant of regular bail in the present case. 5. I have heard learned counsel for the parties and perused the material available on record. 3 6. Perusal of the case diary goes to show that the present applicant is alleged to have dishonestly obtained a total amount of Rs. 26,30,000/- from the complainant to secure employment in the Family Court, Raipur for the complainant's son and nephew, and there are a total of 4 criminal antecedents of the applicant out of which 2 are still pending, looking to the facts and circumstances of the case, it does not seem appropriate to grant bail to the applicant. 7. Accordingly, the bail application of applicant – Raja Bhaiya Lahre, involved in Crime No. 10/2026, registered at Police Station Hirri, District – Bilaspur (C.G) for the offence punishable under Sections 420 of the IPC, is rejected. 8. Needless to say that the trial Court concerned, is at liberty to proceed and conclude the trial expeditiously. 9.
