Learned advocate for the petitioners submits that that the petitioners are innocent and have been falsely implicated in the present case. Learned advocate for the State opposes the prayer for anticipatory bail. I have taken into account the materials on record and the accusations therein and I find that music system was on a trolley and on the ground of being electrified, the victim expired. However, there are some substances in the FIR so far as the accusation under section 105 of the BNS is concerned.
2 Having considered the same, I am of the opinion that custodial detention of the present petitioners may not be warranted in the facts and cumstances of the case. Hence, the prayer for anticipatory bail of the petitioners is Allowed. Accordingly, I direct that in the event of arrest, the petitioners [Sanjay @ Sanjoy Bauri, Ranjan Bauri and Iswar Bauri] be released on anticipatory bail subject to the satisfaction of the arresting officer of the case and also subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and/or under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is in progress, the petitioners shall report to the Investigating Officer (I.O.) of the case within ten days from date and, thereafter, on all subsequent dates, as would be fixed by the I.O. of the case for the sake of investigation till the charge-sheet is submitted before the learned jurisdictional court. Further, the petitioners shall once in a week report to the Dewandighi Police Station. Accordingly, CRM (A) 2569 of 2026 is disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
