Ct.No.5 D/L 04.08.2026 14 Saikat Mukherjee WPA/16665/2026 ARUN KUMAR JHANJ VS. STATE OF WEST BENGAL AND ORS. Mr. Amit Kr. Ghosh, Adv. …For the Petitioner Mr. Suryaneel Das, A.G.P. Ms. Sunita Sarkar, Adv. …For the Respondent-State Ms. Juin Dutta Chakraborty, Adv. Ms. Doyel Dey, Adv. Mr. Bidan Modak, Adv. Ms. Munmun Mondal, Adv. …For the Respondent Nos.7-14 1. At the time of call accommodation is prayed for but same is refused since previously prayer for adjournment made on behalf of the petitioner was granted and matter is fixed for consideration today. 2. Learned advocates representing State-Respondents and respondent nos.7 to 14 have opposed this writ petition on the count that issue involved in this writ petition is civil in nature. 3. On perusal of the prayers couched in this writ petition it transpires that petitioner prays for direction upon the concerned authorities which would facilitate the petitioner to have peaceful possession over the land in question. If possession of the petitioner over land in question is disturbed, in that event, petitioner needs to approach civil court. Police authority is not the appropriate authority to decide right of petitioner over the land in question. 4. Hence, present writ petition is not interfered with and same stands dismissed. 5. However, this order shall not preclude the petitioner to approach civil court in pursuit of remedy. 6. Parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Saugata Bhattacharyya, J.)
