13.08.2026 IN THE HIGH COURT AT CALCUTTA Item No.43 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc. Rejected C.R.M. (M) 938 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Bhagwangola Police Station Case No. 158 of 2025 dated 06.04.2025 under Sections 85/117(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 read with Sections 3/4 of the Dowry Prohibition Act and adding Section 103(1) of the Bharatiya Nyaya Sanhita, 2023. And In Re : Rumaul Sk @ Rumaun Sk ... Petitioner. Mr. Ranadeb Sengupta, Mr. Sachit Talukdar, Mr. Soumyadip Maity, Mr. Saurav Bishnu ... For the Petitioner. Mr. Anamitra Banerjee, Mr. Sreyash Kumar Singh ... For the State. Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 1 year 3 months and till date, out of 29 witnesses cited by the prosecution, only one witness has been examined. As such, petitioner prays for bail on any stringent condition. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that petitioner is the husband of the deceased and there are clinching materials to support the prosecution case. Reference was made to the post mortem report by both the parties. I find that opinion of the doctor relates to combined effects of manual strangulation with head injuries and the same being homicidal in nature. Having regard to 2 the same and the stage of the case, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (M) 938 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities. (Tirthankar Ghosh, J.)
