The case of the prosecution is that the petitioner has borrowed a sum of Rs.5,00,000/- from the de facto complaint with a promise of returning the money as soon as possible. But the petitioner has failed to return the money on time and hence, there was a wordy quarrel between the petitioner and the de facto complainant and the petitioner said to have assaulted the de facto complainant. Hence, this case. 3. The learned counsel for the petitioner submitted that the petitioner is innocent and he has not committed any offence as alleged by the defacto complainant and he has been falsely implicated in this case. He further submitted that he is ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioner. 4. The learned Government Advocate (Crl.Side) submitted that the accused on the pretext that he has got 150 crores in his account, had induced many persons and collected Rs.63 lakhs from various persons and in this connection, he has received Rs.9 lakhs in his account. 5.
From the submission made by the learned Government Advocate (Crl.Side), it is amply clear that it is a clear case of cheating. The contention of the learned Government Advocate (Crl.Side) that only the custodial interrogation of the petitioner would unearth the involvement of others cannot be faulted. Thus, this Court does not find any merits in the present application. Hence, this Court is not inclined to grant anticipatory bail to the petitioner. 6. Accordingly, this Criminal Original Petition is dismissed. 30-03-2026 SHL To:
