Learned advocate for the petitioner submits that the petitioner is in custody for three years two months and till date only two witnesses have been examined, as such, according to the petitioner, there is no possibility of the trial being concluded very soon, as, after the earlier rejection of bail on 19.11.2025, not even a single witness has been completed by the prosecution. Learned advocate for the State submits that the prosecution cannot be solely responsible for the delay. The records do not reflect as to when the learned trial court was informed relating to the period of time which has been fixed by this court. Consequently, I had to go
2 through the evidence of the victim. The evidence of the victim reflects the offence to have been committed by the present petitioner. Having considered that charges have been framed under Section 6 of the POCSO Act, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. However, the trial court is reiterated to ensure expeditious progress of the trial. Accordingly, CRM (M) 1023 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Memo of evidence submitted be kept with the record. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
