Bhatapara, Gramin , District- Baloda Bazar- Bhatapara (C.G.) ... Applicant versus 1 - State Of Chhattisgarh Through The Station House Officer, Police Station - City Kotwali Baloda Bazar, District- Baloda Bazar- Bhatapara (C.G.) ... Non-applicant For Applicant : Shri P. K. Patel, Advocate. For State/Non-applicant : Ms. Smriti Shrivastava, Panel Lawyer. Hon'ble Shri Ramesh Sinha, Chief Justice Order On Board 01/09/2026 1. The applicant has preferred this application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’), for grant of anticipatory bail, apprehending his arrest in connection with Crime No.674/2026, registered at Police Station City Kotwali, Baloda Bazar, NIKITA JAIN Digitally signed by NIKITA JAIN Date: 2026.09.02 11:16:47 +0530 2 District Baloda Bazar - Bhatapara (C.G.) for alleged commission of offence punishable under Sections 305 and 331(4) of B.N.S., 2023. 2. The case of the prosecution, in brief, is that on the night of 07.08.2026 at about 10:00 p.m., the complainant, who was posted as security personnel at the plant, received information from the Security In-charge that some persons had entered the plant premises along with a vehicle with an intention to commit theft in the AFR area. On reaching the spot, a blue-coloured Mahindra Magic vehicle bearing registration No. CG04 PQ 0585 was found parked inside the plant premises, containing iron roller/angle plates belonging to the plant. It is alleged that some persons were also attempting to remove other articles from the plant. On being challenged by the security guards, the persons involved in the alleged theft fled from the spot. The vehicle used in the alleged commission of theft, along with iron rollers and angle plates valued at approximately Rs.1,00,000/-, was found at the spot and seized. On the basis of the report, the offence was registered against the unknown persons. 3. Learned counsel for the applicant submits that the applicant is innocent and has been falsely implicated and there is no specific allegation against him regarding commission of theft. It is submitted further that the alleged incident took place at night and the identification of the persons involved is doubtful and, therefore, learned counsel prays for grant of anticipatory bail. 4. On the other hand, learned State counsel opposes the prayer for grant of anticipatory bail and submits that the allegations are serious in nature and relate to an attempt to commit theft from the plant premises. 3 It is submitted that the incident occurred at night and several persons were involved in the commission of the offence, therefore, the anticipatory bail application of the applicant deserves to be rejected. 5. I have heard learned counsel for the parties and perused the case diary. 6. Taking into consideration the nature and gravity of allegation, the fact that the incident relates to an alleged organised attempt to commit theft from the plant premises during night hours, I am not inclined to grant anticipatory bail to the applicant. 7. Accordingly, the anticipatory bail application of the applicant – Sunil Kumar Kurre, involved in Crime No 674/2026, registered at Police Station City Kotwali, Baloda Bazar, District Baloda Bazar - Bhatapara (C.G.) for alleged commission of offence punishable under Sections 305 and 331(4) of B.N.S., 2023 is rejected.
