The petitioner firm is engaged in the business of supplying of PWS Articles and sanitation materials on both wholesale and retail basis, including supplies to the Gram panchayats upon their requisition, after obtaining necessary licenses from the competent authorities for carrying on such business. While so, respondent No.3 issued work orders dated 20.07.2024 for supply of the materials required for Public Water Scheme and Sanitation works pertaining to the years 2024-2025 relating to the respondent No.3-Gram 4 panchayat. Pursuant thereto, the petitioner supplied the required materials and the receipt thereof was duly acknowledged by the respondent No.3-Gram panchayat. The grievance of the petitioner is that notwithstanding the supply of the materials to the respondent No.3-Gram panchayat, the respondent Nos.1 and 2 are not releasing the funds to the respondent No.3-Gram panchayat for the purpose of making payment to the petitioner for the last three years. Aggrieved thereby, the present writ petition has been filed by the petitioner herein to direct the respondents to pay the bills through work order dated 20.07.2024 vide Credit Bill No.80 for an amount of Rs.2,49,985/- along with interest @ 24% per annum. 3. Heard. Perused the record. 4. Learned Standing Counsel appearing on behalf of respondent No.3, on written instructions, submits that the petitioner supplied sanitation materials sanctioned under G.P. General Funds and is entitled for an amount of Rs.2,49,985/-. However, due to lack of sufficient funds with the Gram panchayat, the said amount could not be released till date. He further submits that the in view of some financial constraints being faced by the respondent No.3-Gram panchayat, it undertakes to pay the entire amount to the petitioner, subject to availability of funds after meeting the necessary expenditure towards sanitation and water maintenance. The written instructions are placed on record. 5 5. Having regard to the fact that there is no dispute with regard to the supply of sanitation work materials by the petitioner and the amount payable to him, and in view of the submissions made by the learned Standing Counsel for respondent No.3, the respondent authorities are directed to pay a sum of Rs.2,49,985/- (Rupees Two Lakhs Forty-Nine Thousand Nine Hundred and Eighty-Five only) to the petitioner within a period of eight (8) weeks from the date of receipt of a copy of this order. 6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.
