KRISHNA KUMAR BARVE Digitally signed by KRISHNA KUMAR BARVE Date: 2026.09.01 19:26:35 +0530 2 2. Case of the prosecution is that on 14.05.2026, an information was received by the police authorities from an informant that a person is selling ganja near Bhojpur gas agency The police authorities reached the spot and conducted the raid and found the applicant in possession of 2.1 Kg of Ganja. On the basis of aforesaid story of the prosecution, an FIR was lodged against the present applicant for the offence of Section 20(b) of NDPS in connection with crime no. 234/2026 at Police Station- Champa, Dist.- Janjgir Champa (C.G.). Hence the bail application. 3. It has been argued by learned counsel for the applicant that the applicant is innocent and has been falsely implicated in the crime. The Applicant has not committed any offence and she has been falsely implicated by the Police without there being any evidence against her. The applicant is aged about 54 years and she is in jail since 14.05.2026. The trial Court failed to appreciate that the investigation is already complete and the applicant is in custody for more than 3 months. The trial Court failed to appreciate that the applicant lives with her minor girl alone and she is the only caretaker of the minor child. The trial court failed to appreciate that the substance seized from the applicant falls in the intermediate quantity as per the NDPS Act. The trial court failed to appreciate that the present applicant has one previous criminal records/antecedent. Therefore, the applicant may be released on bail. 3 4. On the other hand, learned counsel appearing for the State/non- applicant would oppose the bail application and submit that the applicant has one criminal antecedent registered against her under the NDPS Act and charge sheet has already been submitted against the applicant. Therefore, the present bail application may be rejected. 5. I have heard learned counsel appearing for the parties and perused the case diary. 6. Taking into consideration the facts and circumstances of the case and the fact that charge sheet has already been submitted against the applicant and that the applicant has one criminal antecedent registered against her under the NDPS Act, this Court is not inclined to release the applicant on bail. 7. Accordingly, the bail application of applicant – Mongra Bai Kenvat, involved in Crime No.234/2026 registered at Police Station Champa, District Janjgir-Champa (C.G.) for the offence under Section 20 (b) of the NDPS Act, is rejected. - Sd/- (Ramesh Sinha) Chief Justice Barve
