1. Affidavit of service filed on behalf of the petitioners is taken on record.
2. It is contended on behalf of the petitioners that petitioners are Bargadars of land in question and private respondents are restraining the petitioners from cultivating said land. Petitioners pray for direction upon the concerned police authorities to take steps in order to facilitate the petitioners to cultivate said land.
3. State respondents are represented by learned advocate.
4. Having considered the case made out in this writ petition, it appears that petitioners are claiming to be Bargadars of land in question and petitioners are restrained by private respondents from cultivating said land. If petitioners find that their right to cultivate said
2 land is being infringed by private respondents in that event petitioners need to approach appropriate forum in order to assert their right as Bargadars over the land in question. Police authority is not the appropriate authority to decide inter se right of the parties over the land in question.
5. Hence, writ petition is not interfered with and same stands dismissed.
6. However, this order shall not preclude the petitioners to approach appropriate forum in pursuit of remedy.
7. Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
