ORAL ORDER (PER: HON'BLE MR. VIBHU BAKHRU, CHIEF JUSTICE)
1. The complainant has filed the present complaint alleging willful disobedience of the order dated 19.02.2026 passed by the learned Single Judge in WP.No.15052/2025 (GM-RES). The operative part of the said order reads as under:
"The respondents must be at liberty to complete their pleadings, and the question for consideration today is should this Court in the light of the orders in the writ petition in WP No.15689/2024 stay the appointment of the third respondent as the Official Liquidator. This Court opines that when pleadings are yet to be completed, the third respondent must not bring the petitioner's assets to sale or be precipitative. It is

ordered accordingly. However, this order will not preclude the third respondent from otherwise continuing as the Official Liquidator."

The accused was arrayed as respondent No.3 and issued a notice dated 04.03.2026 for setting out certain agenda items, including to take note of the updates regarding liquidation process, to make note of the liquidation expenses and to ratify the appointment of legal counsel. The learned Senior Counsel appearing for the complainant submits the said agenda Items constitutes willful disobedience of the interim order dated 19.02.2026, as it would constitute precipitated steps. She also submits that the accused cannot act as a liquidator as the same has been stayed pursuant to an order passed in under WP.No. 15689/2024. 3. We note that the said order is not on record. A plain reading of the order dated 19.02.2026 indicates that the accused was not precluded from continuing as an official liquidator. The agenda, prima facie, indicates the steps that a liquidator is required to take. In this view, we are unable to accept that any proceedings for willful

disobedience of the order dated 19.02.2026 are required to be initiated under the Contempt of Courts Act, 1971. 4. Insofar as the contention that the accused has violated the orders passed in WP.No.15689/2024 is concerned, we do not consider it necessary to examine the same in this proceedings.
However, we clarify that in the event any other order passed by the court has been violated, the complainant is not precluded from initiating steps or availing remedies in accordance with law. The complaint is closed with the aforesaid observation. Sd/- (VIBHU BAKHRU) CHIEF JUSTICE
