07.08.2026 Serial no. 14 [G.S.D] CRM (NDPS) 1449 of 2026 In re : An Application for Bail under Section 439 of the Code of Criminal Procedure, 1973/under Section 483 of the BNSS, 2023 in connection with Kaliachak PS Case No. 1880 of 2025 dated November 5, 2025 u/s 21(c)/27A/29 of the NDPS Act -And- In the matter of : Parvej Momin … Petitioner(s) Mr. Sabir Ahmed Mr. Najmul Hoque Choudhury … for the Petitioner(s) Mr. Shatarup Purkayastha … for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is in custody for about nine months and total quantum of contraband seized in the present case is 2 kg 27 gm of brown sugar. Learned advocate insists that a part of the seizure was from the present petitioner and there are serious discrepancies relating to the time when the General Diary Entry was registered prior to initiation of the present case. Learned advocate for the State produces the chemical examiner’s report. I have taken into account the overall circumstances, quantum of seizure in the present case including the reports and the issues which have been canvassed and I am of the opinion that all these issues are question of facts which will 2 be adjudicated at the stage of trial. So far as the issue relating to bail is concerned, I am of the opinion that the rigors of Section 37 of the NDPS Act are attracted. Having considered the same, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is Rejected. The petitioner would renew his prayer for bail after the evidence of the seizure list witnesses is over. Accordingly, CRM (NDPS) 1449 of 2026 is dismissed. Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta. Urgent Photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities. (Tirthankar Ghosh, J.)
