JUSTICE ANUROOP SINGHI Order 16/03/2026 1. Learned counsel for the petitioners submits that while an appeal filed by the petitioners along with the stay application are pending since the year 2009, on one hand no order is being passed on the stay application filed by the petitioners, on the other hand, very recently a notice dated 15.02.2026 has been issued by the SHO Shahpura, District Jaipur Rural for executing the decree and order passed by the Sub-Divisional Officer, Shahpura, Jaipur Rural dated 07.03.2007. 2. Learned counsel for the petitioners submits that the said communication dated 15.02.2026 has been issued without any authority of law and is in teeth with the provisions of the Rajasthan Tenancy Act, 1955 (for short “the Act of 1955”). 3. Learned counsel for the petitioners further submits that the communication dated 15.02.2026 could not have been issued more particularly in light of the Section 184 of the Act of 1955. Learned counsel for the petitioners prays that taking note of the communication dated 15.02.2026, the learned Board of Revenue, Ajmer may be directed to decide the stay application of the petitioners at the earliest and in a time bound manner. 5. Considering the limited prayer made by the learned counsel for the petitioners, without delving into the merits of the case and further taking note of the fact that an appeal along with a stay application filed by the petitioners are pending since the year 2009, the learned Board of Revenue, Ajmer is directed to consider and pass an order on the stay application filed by the petitioners within a period of two weeks from the date of submission of the certified copy of this order. 6. The stay application be decided strictly in accordance with law by passing a speaking and reasoned order after affording an opportunity of hearing to the parties. 7. With the aforesaid directions, the writ petition is disposed of. 8. Pending application(s), if any, stand disposed of. 9. Needless to say, this order has been passed only to decide the stay application of the petitioners strictly in accordance with law and in no manner be construed as a direction to decide the said application in a particular manner.
