CG State Electricity Distribution Co. Ltd. and others), whereby, application filed by the plaintiff Order 39 Rule 1 & 2 read with section 151 of the Civil Procedure Code has been rejected. However, vide order dated 27.11.2024 the original civil suit has been withdrawn by the appellant/plaintiff by filing application under Order 23 Rule 1 CPC before the trial Court. In this regard covering memo dated 06.01.2025 has been filed by the respondents No.1 and 2 along with order- sheet dated 27.11.2024. It is submitted that, since the original suit has been withdrawn and disposed of, this appeal has become infructuous. 2. Learned counsel for the appellant has not controverted the above submission. 3. In view of the submissions made by the learned counsel for respondent Nos. 1 and 2, and upon perusal of the order-sheet dated 27.11.2024 passed by the learned Sixth District Judge, Durg in Civil Suit No. 45A/2021 (Madhuri Mandavi v. CG State Electricity Distribution Co. Ltd. & Ors.) whereby permission was granted to withdraw the civil suit, resulting in its disposal, the present appeal has become infructuous, therefore, this appeal is disposed of as rendered infructuous. 4.
