Also heard Ms. B. Sarma, learned CGC; Mr. A.I. Ali, learned standing counsel for the ECI; Mr. G. Sharma, learned standing counsel for the FT matters and NRC; and Mr. P. Sarmah, learned Additional Sr. Govt. Advocate for respondents. 2. By filing this interlocutory application, the applicant, who has filed the connected WP(C) 998/2026, has prayed for a stay of the operation of the impugned notice dated 03.12.2025 issued by the learned Member, Foreigners Tribunal No. 7th, Tezpur, Balipara, in F.T Case No. DC. 1716/16, arising out of SP (Border’s Reference No. TZP(B) 95/947), requiring the applicant’s presence
Page No.# 3/3 before the Tribunal. 3. It is also noticed that in the connected WP(C) 998/2026, the proceedings of F.T Case No. DC. 1716/16 is not under challenge. Thus, the prayer made in the interlocutory application is not in aid to the reliefs sought in the connected writ petition. 4. The Court is not inclined to entertain this interlocutory application, which is in respect of and/or connected with the challenge to the proceedings made in the connected writ petition. 5. However, it is made clear that this order shall not prejudice the applicant while assailing the proceedings of F.T Case No. DC. 1716/16 in an appropriate manner, as the applicant may be so advised. 6.
