ORDER PUBLIC the 2 THE HONOURABLE DR JUSTICE VENKATA JYOTHIRMAI PRATAPA CRIMINAL PETITION No: 2409 of 2026 Order: The Criminal Petition under Sections 480 and 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), has been filed by the petitioner/Accused No.1, seeking regular bail in Crime No.95 of 2025 of Karamchedu Police Station, Bapatia District, registered for the offence under Section 194 of BNSS. 2. Case of the prosecution, in brief, is that the de facto complainant has one son and one daughter. His daughter, Kokila, was married about five years ago to Maddela Naga Sai Praveen Kumar of Gudiwada Village, Krishna District, in the presence of elders, and they were blessed with a male child aged about three years. Due to matrimonial disputes, about ten months prior to the incident, the deceased returned to her parental home along with her child. On 17.12.2025, between 09:00 hours and 12:00 hours, she committed suicide by hanging herself with her dupatta in the bathroom of her parental house, allegedly due to family disputes. 3. Heard Smt. Y. L. Siva Kalpana Reddy, learned counsel for the petitioner and Ms. K. Priyanka Lakshmi, learned Assistant Public Prosecutor representing the respondent-State. 4. Learned Assistant Public Prosecutor would submit that notice has been served on de facto complainant and she got instructions to argue the matter. 3 Learned counsel for the petitioner submits that due to matrimonial 5. disputes between the petitioner (Accused No.1) and the deceased, the deceased had been residing at her parental house for about ten months prior to the alleged incident. The couple was blessed with a male child, who was residing with the mother. It is further submitted that the petitioner had filed H.M.O.P.No.61 of 2025 before the learned Principal Civil Judge (Senior Division), Gudivada, seeking restitution of conjugal rights. It is contended that during the course of reconciliation proceedings in the said H.M.O.P allegations were made that the petitioner intended to take custody of the child and pursue appropriate legal remedies. It is further submitted that the deceased, being worried about her child and her stressed matrimonial life was in a vulnerable condition and committed suicide. Learned counsel further submits that the petitioner has been in judicial custody since 09.02.2026 and is ready to furnish sureties to the satisfaction of the Court. Per contra, the learned Assistant Public Prosecutor opposed the petition 6. and prayed that appropriate orders may be passed by the Court. 7. Considering the submissions made and upon a careful perusal of the material on record, it is an unfortunate case where the death occurred within seven years of marriage. However, it is not in dispute that the deceased had been residing at her parental home for about ten months prior to the incident and the suicide took place there. It is also pertinent that the petitioner had initiated proceedings for restitution of conjugal rights, which are pending beforethe competent Court, and both parties had participated in reconciliation proceedings. At this stage, this Court is not inclined to adjudicate upon the culpability of the petitioner by accepting the allegations at their face value. As regards the investigation, it is stated that the same is pending receipt of the RFSL report, and the substantial part of the investigation appears to have been completed. In view of the facts and circumstances of the case, this Court is inclined 8. to grant bail to the petitioner/Accused No.1, on the following conditions. i) Petitioner/Accused No.1 shall be released on bail on his executing a personal bond for Rs.20,000/- (Rupees twenty thousand only) with two sureties for a like sum each to the satisfaction of the learned Judicial Magistrate of First Class, Parchur, Bapatia District. (ii) On release, the petitioner/Accused No.1 shall appear before the Station House Officer concerned, once in a fortnight i.e., on every second and fourth Sunday between 10.00 a.m. and 05.00 p.m., until filing of the charge sheet.
