WPA 1235 of 2022 Maumita Ghosh Versus The State of West Bengal & Ors. Mr. Ekramul Bari. …for the petitioner.
1. In spite of service of copy through the office of the learned Government Pleader, none appears for the State respondents.
2. Let affidavit of service be taken on record.
3. On perusal of record, it transpires that in connection with the petitioner’s claim for grant of post graduate scale of pay, the respondent/District Inspector of Schools (Secondary Education), Howrah though has sent his queries back in the year 2019, precisely vide letter dated September 23, 2019 addressed to the Headmaster, Brahminpara High School (H.S), Munshirhat, Howrah. No further proceeding has taken place towards the petitioner’s prayer as above on behalf of the respective authority. Such inordinate delay on the part of the respondent authority considering her prayer for grant of post graduate scale of pay has been challenged by the petitioner in the instant writ petition.
4. Considering the facts and circumstances, let this writ petition be disposed of directing the Headmaster,
Brahminpara High School (H.S), Munshirhat, Howrah, to immediately respond to the queries raised by the District Inspector of Schools (Secondary Education), Howrah vide letter dated September 23, 2019, positively within a period of 7 days from the date of communication of a copy of this order.

The respondent/District Inspector of Schools (Secondary Education), Howrah is further directed to take necessary steps and decision with respect to the petitioner’s prayer as above, within a period of 3 weeks from the date of receipt of the reply to these queries from the Headmaster, Brahminpara High School (H.S), Munshirhat, Howrah.
6. Let the respondent/District Inspector of Schools (Secondary Education), Howrah dispose of the petitioner’s prayer as above in accordance with law, particularly, with reference to the law settled by the Hon’ble Larger Bench of this Court in the case of Utpal Kanti Karan vs. State of W.B. reported in 2024 SCC Only Cal 1274.
7. With the directions as above, the instant writ petition is disposed of.
8. There shall be no order as to costs.
9. All the parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Rai Chattopadhyay, J.) 2
