Upon noticing the police party, the said accused persons became perplexed and threw away a polythene bag. Search of the said polythene bag allegedly thrown by them led to the recovery of 60 loose intoxicant tablets and 35 strips of intoxicant capsules labelled “Signore” (Pregabalin Capsules IP 300 mg), each strip containing 15 capsules, totaling 525 capsules. 3. Cousnel for the petitioner submits that name of the present petitioner has surfaced in the case solely on the basis of disclosure statement made by the co-accused, wherein petitioner has been alleged to be the supplier of the recovered contraband.
Learned counsel for the petitioner contends that petitioner has been falsely implicated in the present case. It is argued that, apart from the disclosure statement of the co-accused, no independent or substantive evidence has been collected by the prosecution to establish the involvement of the petitioner in the alleged offence. As regards the other 60 loose tablets, although they are alleged to be intoxicating in nature, but FSL report is still awaited. Therefore, it remains a debatable issue as to whether the provisions of NDPS Act are at all attracted in the facts and circumstances of the present case, or not. Lastly, it is contended that petitioner is ready and willing to join the investigation and to fully cooperate with the investigating agency. Thus, counsel prays for grant of concession of anticipatory bail to the petitioner in the present case.
