Learned advocate appearing for the petitioner submits that the petitioner is in custody for one year six months and has been detained for alleged recovery of 60 kgs of poppy. The seizure list witnesses according to the petitioner did not support the prosecution case. Learned advocate appearing for the State submits that there are other materials including videography so far as the seizure has been effected. The land from where recoveries have been made belongs to the present petitioner and there are documentary evidence to that effect. Having considered the overall circumstances, particularly, the period of detention, State is directed to expedite the process of trial as the petitioner is in custody for one year six months.
2 With the aforesaid observations CRM (NDPS) 1523 of 2026 is dismissed at this stage. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
