Heard Mr. Ashok Kumar Shukla, learned counsel for the appellant, as well as Mr. S.S. Baghel, learned Government Advocate, appearing for the State, and Mr. Malay Shrivastava, learned counsel, appearing for respondent No. 2, on I.A. No. 2 of 2026, which is an application for condonation of delay. 2. After hearing the learned counsel for the parties and considering the reasons mentioned in the application, we are of the considered opinion that sufficient cause has been shown in the application. Accordingly, I.A. No. 2 of 2026 is allowed and the delay of 39 days in filing the appeal is condoned. 3. The present intra-court appeal has been preferred by the appellant assailing the order dated 27.04.2026 passed by the learned Single Judge in WPC No. 1997 of 2026 (Dalip Singh vs. State of Chhattisgarh & Others), whereby the writ petition filed by respondent No. 8/writ petitioner herein came to be disposed of. 3 4. Learned counsel for the appellant submits that the appellant herein was respondent No. 7 in the aforesaid writ petition. Though the appellant was impleaded as respondent No. 7 in the writ petition, he was not afforded an opportunity of hearing before the learned Single Judge. Learned counsel for the appellant, therefore, submits that the present appeal may be dismissed as withdrawn, with liberty to the appellant to take recourse to an appropriate remedy before the learned Single Judge. 5. Learned State counsel, as well as learned counsel appearing for respondent No. 2, have no objection to the prayer made by learned counsel for the appellant. 6. In view of the submission made by learned counsel for the appellant, the present writ appeal is dismissed as withdrawn, with liberty, as prayed for, to the appellant to take recourse to an appropriate remedy before the learned Single Judge.
