Debasish Saha Vs. The State of West Bengal
Mr. Ansuman Bera …for the petitioner
The petitioner in this application has made an innocuous prayer for passing a direction upon the Court below for expeditious disposal of the proceeding being G.R. Case No.3446 of 2016 presently pending before learned Judicial Magistrate, 1st Court, Barasat. Being aggrieved by the inordinate delay caused in disposal of the said proceeding, learned Counsel for the petitioner submits that the FIR in connection with the said criminal proceeding was initiated on 21st July, 2016 and thereafter police submitted charge sheet on 31st December, 2016 after completion of investigation. Charge against the petitioner was framed on 13.11.2019 under Sections 498A/406 of the Indian Penal Code. Since then for about 7 years, the case is pending for recording evidence of prosecution witnesses. Therefore, he prayed for necessary direction. Having heard learned Counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made in the application, the opposite
2 party will have no cause to prejudice and, as such, service of copy of application upon the opposite party is dispensed with. Having considered the fact that after framing of charge in the year 2019 not a single witness could be examined so far, I find that the prayer made by the petitioner is justified and required to be allowed to secure the ends of justice. In view of above, let the CRR 3125 of 2026 be hereby disposed of with a direction upon the Court below to make every endeavour for expeditious disposal of the said proceeding and to make his best effort to conclude the entire proceeding within a period of six months from the next date of hearing. Parties to act on a server copy of this order duly collected from the official website of the Hon’ble High Court, Calcutta.
