Learned advocate appearing for the petitioners submits that the petitioner no.1 is the father-in-law, petitioner no.2 is the mother-in-law, petitioner no.3 is the husband and petitioner no.4 is the brother-in-law. Learned advocate further submits that after three years of marriage the wife on other issues has falsely implicated whole of the inmates of the matrimonial home for harassing them. Learned advocate for the State opposes the prayer for anticipatory bail and produces the case diary. 2
I have taken into account the materials appearing in the case diary including the statement of the witnesses. Having assessed the overall materials and the fact of the case, I am of the opinion that custodial detention of the petitioner nos.1, 2 and 4 is uncalled for. As such, the prayer for anticipatory bail of the petitioner nos.1, 2 and 4 is allowed. However, so far as the petitioner no.3, namely, Md. Binod Sk. is concerned, the prayer for anticipatory bail is rejected. Accordingly, in the event of arrest, the petitioner no.1, namely, Nantu Seikh, petitioner no.2, namely Basira Bibi Sekh and petitioner no.4, namely, Bapon Sk. shall be released on bail to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure corresponding to Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. As the investigation of the case is still in progress, petitioner nos. 1 and 4 shall report to the investigating officer of the case within a period of 10 days from date and thereafter on all subsequent dates fixed by the investigating officer of the case. So far as the petitioner no.2 is concerned, she would make herself available as and when required by the investigating officer of the case.
With the aforesaid observations, CRM(A)2249 of 2026 is partly allowed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. 3
