(NDPS) 1720 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Ranitala Police Station Case No. 89 of 2026 dated 22.02.2026 under Sections 21(c)/29 of the Narcotic Drugs and Psychotropic Substances Act, 1985. And In Re : Rashidul Sk. @ Liton and another ... Petitioners. Mr. Jisan Iqubal Hossain ... For the Petitioners. Mr. Debojyoti Adhikary, Mr. Soumya Raha ... For the State. Learned advocate appearing for the petitioners submits that total recovery in the present case is 191 bottles of Choco Cough Syrup. Petitioners are in custody for six months and charge-sheet has already been submitted before the jurisdictional court. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. On a query, learned advocate for the State submits that Memo of Evidence submitted by the police authorities do not reflect previous antecedent of the present petitioners. Having considered that the charge-sheet refers to 15 witnesses on whom the prosecution would rely and the time which will be consumed to take the trial to its logical conclusion, I am inclined to release the petitioners on bail. As such, the prayer for bail of the petitioners is allowed. 2 Accordingly, the petitioners viz., 1. Rashidul Sk. @ Liton and 2. Najibur Sk. shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, 2nd Court, Berhampore, Murshidabad. If on bail, the petitioners shall be physically present on each and every date before the learned Special Court and shall not leave the jurisdiction of the district of Murshidabad without prior permission of the learned Special Court. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (NDPS) 1720 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
