Learned advocate appearing for the petitioner submits that the petitioner is in custody for 2 years 1 month. There is no possibility of the trial concluding in near future as till date, out of nine witnesses, only one witness has been examined and evidence of second witness is in progress. Emphasis has been made by the learned advocate on the fact that evidence of vulnerable witnesses has already been completed. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail. I have taken into account the materials appearing in the case diary including the factum of the case which prima facie alleges that petitioner firing at the stomach of the victim. Victim survived because of subsequent medical 2 intervention. Be that as it may, having considered the gravity of the offence, at this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 940 of 2026, is, thus, dismissed. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
