Petitioner is in custody for 1 year and 7 months. The subject matter of the case relates to alleged recovery of 14,485 bottles of Phensedyl. Some of the other accused persons have been released on bail/anticipatory bail.
So far as the present petitioner is concerned, earlier his bail was rejected on December, 2025. Till date only 4 witnesses have been examined. Prosecution has relied upon 28 witnesses in order to prove its case.
Learned advocate for the State has raised objection.

I have taken into account the complicity of the petitioner, particularly with regard to how the name cropped up and whether there has been any money trail. On perusal of the same and without entering into the merits of the case, I am inclined to release the petitioner on bail.
Accordingly, prayer for bail of the petitioner is allowed. Accordingly, Petitioner, namely, Anup Kayal shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each, one of whom must be local to the satisfaction of Learned Judge, under NDPS Act, Paschim Medinipur. If on bail, the petitioner shall be physically present on each and every date fixed before the learned Trial Court and shall not leave the jurisdiction of District of Paschim Medinipur without the prior permission of the learned Special Court.
Accordingly, CRM (NDPS) 1409 of 2026 is allowed.
