THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE S.G.PANDIT AND HON'BLE DR. JUSTICE K.MANMADHA RAO ORAL ORDER (PER: HON'BLE MR. JUSTICE S.G.PANDIT) The above review petition is filed praying to review the order dated 20.03.2025 in W.P.No.16739/2023 whereunder the challenge of the petitioners-State to the order of the Tribunal dated 22.02.2023 in Review Application No.141/2021 as well as Application No.1044/2020 was rejected. 2. The Tribunal in Application No.1044/2020 directed the State Authorities to issue a notification - 3 - HC-KAR CNR: KAHC010488312026 NC: 2026:KHC:40317-DB RP No. 390 of 2026 considering the respondent herein as appointed under the Karnataka Daily Wage Employees Welfare Act, 2012 as FDA with effect from the date of notification dated 29.07.2015 and to pay all consequential benefits with interest. The challenge to the above order, was dismissed by this Court under order dated 20.03.2025 in W.P.No.16739/2023, which is the subject matter of this review petition. 3. It is noticed that against the order under review, the petitioners – State had approached the Hon'ble Apex Court in Special Leave Petition (Civil) Dairy No.8119/2026 and the Hon'ble Apex Court by order dated 16.03.2026 passed the following order: “1. Delay condoned. 2. We do not find any good ground to entertain this petition. The special leave petition is , accordingly, dismissed. 3. Pending application(s), if any, shall stand disposed of.” - 4 - HC-KAR CNR: KAHC010488312026 NC: 2026:KHC:40317-DB RP No. 390 of 2026 4. The Hon'ble Apex Court has categorically held that they do not find any good grounds to entertain the Special Leave Petition and accordingly dismissed the Special Leave Petition. When the Hon'ble Apex Court has found that there is no good ground to entertain the SLP, it may not be proper for this Court to entertain the present review. Accordingly, review petition stands rejected. 5. Learned Additional Government Advocate Sri.Vikas Rojipura for the petitioners – State submits that the cost imposed by the Tribunal was waived subject to the appellants/State implementing the order within eight weeks. Learned Additional Government Advocate would submit that since the State had approached the Hon’ble Apex Court by filing Special Leave Petition and thereafter the State approached this Court in the present review petition, the order could not be implemented. He submits that the order under review would be implemented within - 5 - HC-KAR CNR: KAHC010488312026 NC: 2026:KHC:40317-DB RP No. 390 of 2026 eight weeks. Hence, he would pray for waiving of the cost as imposed by the Tribunal. 6. Taking note of the above submission, we are of the opinion that the Tribunal is not justified in awarding cost of Rs.10,000/- on the petitioners-Sate. Accordingly, the cost of Rs.10,000/- imposed by the Tribunal on the State is waived, subject to the petitioners-State implementing the order under review within four weeks from the date of uploading this order on the website of the High Court of Karnataka.
